Terms of Service

1. Acceptance of Terms

By accessing or using the LifeLinkX mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Eryx Labs Ltd ("we", "us", "our"), a company registered in Kenya. If you do not agree to these Terms, do not use the Service.

2. Description of Service

LifeLinkX is a medication management platform that connects patients with licensed pharmacies in Kenya. The Service provides:

• Medication refill reminders and adherence tracking
• One-tap prescription refill ordering
• M-Pesa payment processing for pharmacy orders
• Prescription upload and pharmacist verification
• Pharmacy product browsing and ordering
• Caregiver access for designated family members

LifeLinkX is a technology platform that facilitates transactions between patients and pharmacies. We are not a pharmacy, healthcare provider, or medical practice. All medications are dispensed by licensed pharmacies registered with the Pharmacy and Poisons Board (PPB) of Kenya.

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent that you are at least 18 years old and that the information you provide is accurate and complete. Caregivers may manage medications for minors or dependants, but the caregiver must be the registered account holder.

4. Account Registration

To use the Service, you must register using a valid Kenyan mobile phone number. Your phone number serves as your primary identifier. You are responsible for:

• Providing accurate and current information
• Maintaining the security of your phone and OTP codes
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorised access to your account

5. Prescriptions and Medications

You acknowledge and agree that:

• LifeLinkX does not prescribe medications. All prescriptions must come from a licensed healthcare provider.
• Prescription medications require a valid prescription. The pharmacy will verify prescriptions before dispensing.
• Controlled substances are subject to additional verification requirements under the Pharmacy and Poisons Act.
• Medication reminders are informational aids and do not constitute medical advice. Always follow your healthcare provider's instructions.
• You are responsible for informing your healthcare provider of all medications you take, including those ordered through LifeLinkX.

6. Orders and Payments

When you place an order through LifeLinkX:

• You are placing an order with the pharmacy, not with Eryx Labs Ltd. The pharmacy is the seller of record.
• Prices are set by the pharmacy and may vary. Prices displayed at the time of order confirmation are final.
• Payment is processed via M-Pesa through our payment partner, KopoKopo. You will receive an M-Pesa STK Push prompt to authorise payment.
• Orders are confirmed once payment is successfully processed. The pharmacy may reject an order if stock is unavailable or if a prescription cannot be verified.
• Refunds for rejected or cancelled orders are processed within seven (7) business days to your M-Pesa account.

7. Pharmacy Responsibilities

Pharmacies using LifeLinkX are independently licensed businesses. Eryx Labs Ltd is not responsible for:

• The quality, safety, or efficacy of medications dispensed by pharmacies
• Pharmacy operating hours, stock availability, or delivery timelines
• Any clinical advice provided by pharmacy staff
• Pharmacy compliance with PPB regulations (each pharmacy is independently responsible)

8. Caregiver Access

You may designate caregivers who can view your medication information and, if permitted, place orders on your behalf. By adding a caregiver, you consent to sharing the specified information with that person. You can modify or revoke caregiver access at any time through your profile settings.

9. Notifications

By using the Service, you consent to receiving transactional notifications via SMS, WhatsApp, and push notifications. These include medication reminders, order confirmations, and delivery updates. You can customise your notification preferences in the app. Transactional notifications related to active orders cannot be fully disabled while an order is in progress.

10. Prohibited Uses

You agree not to:

• Use the Service to obtain medications for which you do not have a valid prescription
• Provide false identity information or use another person's account
• Attempt to circumvent prescription verification processes
• Use the Service for any illegal purpose, including diversion of controlled substances
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service

11. Intellectual Property

The LifeLinkX name, logo, and all related marks, designs, and content are the property of Eryx Labs Ltd. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by Kenyan law:

• LifeLinkX is provided "as is" without warranties of any kind.
• Eryx Labs Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
• We do not guarantee uninterrupted or error-free service.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

13. Termination

You may close your account at any time by contacting us or through the app's settings. We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy and applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from or relating to the Service shall be resolved through arbitration in Nairobi under the Nairobi Centre for International Arbitration rules, unless the dispute involves a claim that may be brought in the small claims court.

15. Changes to Terms

We may modify these Terms from time to time. We will provide at least 14 days' notice of material changes via SMS or in-app notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
